Wired described an interesting way to fix the patent mess - make applicants submit models of their inventions, which was the norm until 1880. It would reduce the inflow of patents, make it easier on the examiners, you can’t build a model of something vague, and you can’t build a model out of ideas, like software or business processes. Which is perfect - creative works have plenty of protection under copyright laws in a way that doesn’t cater to trolls.
